Eye-Fi & Animoto Sweepstakes – Official Rules.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN IN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited by law.
1. Promotion Period: The Eye-Fi Sweepstakes (”Promotion”) begins at 9:00 A.M. PDT on December 27, 2010 and ends at 11:59 P.M. PDT on December 29, 2010 (”Promotion Period”). One winner per calendar day.
2. How to Enter: During the Promotion Period, visit www.facebook.com/eye.fi, and answer the wall post question. You must become a fan of the Eye-Fi Facebook page and a fan of the Animoto page– you can do so by signing into Facebook and “Liking” the Eye-Fi page and “Liking” the Animoto page. All three of these steps must be completed in order to enter the contest. Normal Internet access and usage charges imposed by your on-line service will apply. All entries must be received by 11:59 P.M. PDT on December 29, 2010, to be eligible. Limit one entry per person; entries subsequent to the first entry will be ignored. Any entry not in conformance with Facebook’s Terms of Service, or deemed inappropriate or unsuitable or containing any obscene, profane, lewd or defamatory content, in Sponsor’s sole discretion, will be disqualified. Answers to the wall post question must be bona-fide and original creations by entrant. By entering the Promotion, you hereby grant the Sponsor, Animoto Inc., and their respective advertising and promotional agencies, affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, reproduce, re-arrange, change, add to or delete from, translate, adapt or otherwise revise and/or alter the review and promote the review, for editorial, commercial, promotional and all other purposes, in Sponsor’s and Animoto’s sole discretion. Answers must be written during the promotion period.
3. Random Drawing: One (1) prize winner will be randomly selected from among all eligible entries received per calendar day during the Promotion Period. The drawing will be held on or about December 30, 2010 by Eye-Fi, Inc. (“Sponsor”), whose decisions will be final on all matters relating to this Promotion. Odds of winning depend upon the total number of eligible entries received.
4. Notification of Winners: Potential winners will be notified by e-mail and will be required to reply with a valid physical mailing address, within 7 days of notification, to receive their prize. Noncompliance within this time period or return of prize as undeliverable will result in disqualification and alternate winner selection. By accepting the prize, winner consents to the use of his or her name, photo, likeness and product review for purposes of advertising, publicity and promotion, without additional compensation or permission, unless prohibited by law.
5. Prizes (3) and Approximate Retail Value (“ARV”): each Grand Prize winner will receive one (1) Animoto All-Access Pass (ARV $29.99). No substitutions allowed, except by Sponsor who reserves the right to award a prize of equal or greater value if advertised prize is unavailable.
6. Eligibility: This Promotion is open only to legal residents of the 50 United States and Washington, D.C., who are 18 years of age or older as of the date of entry. Employees and their immediate family members of Sponsor, their subsidiaries, divisions, affiliates and related companies, advertising and promotion agencies, are not eligible. By entering the Promotion, participants are bound by and agree to these official rules and the decisions of the judges. All federal, state and local laws and regulations apply. Void where prohibited by law.
7. General Rules: Online entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Promotion or website, violates the Official Rules or acts in an un-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor, Animoto, and their affiliates are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Promotion which may limit the ability to participate or by any human error which may occur in the processing of the entries in this Promotion. Sponsor reserves the right to cancel the Promotion if it becomes technically corrupted, and award prizes from eligible entries received prior to cancellation.
8. Release. By entering the Promotion, entrant releases and agrees to hold harmless Sponsor, Animoto, and their respective suppliers, parents, affiliates, subsidiaries, and their and their officers, directors, employees, representatives, agents, advertising, promotion, production and fulfillment agencies, successors and assigns (collectively, “Released Parties”) from and against any liability of any kind in connection with the Promotion, including without limitation any costs, fees, expenses, or damages incurred in the use of the prizes.
9. Venue. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the Santa Clara County Superior Court, U.S.A; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor, or entrant and Animoto, in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
