Eye-Fi Limited Warranty & Liability Information
FOR CONSUMERS, WHO ARE COVERED BY CONSUMER PROTECTION LAWS OR REGULATIONS IN THEIR COUNTRY OF PURCHASE OR, IF DIFFERENT, THEIR COUNTRY OF RESIDENCE, THE BENEFITS CONFERRED BY THIS WARRANTY ARE IN ADDITION TO ALL RIGHTS AND REMEDIES CONVEYED BY SUCH CONSUMER PROTECTION LAWS AND REGULATIONS. THIS WARRANTY DOES NOT EXCLUDE, LIMIT OR SUSPEND ANY RIGHTS OF CONSUMERS ARISING OUT OF NON-CONFORMITY WITH A SALES CONTRACT. SOME COUNTRIES, STATES AND PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY OR CONDITION MAY LAST, SO THE LIMITATIONS OR EXCLUSIONS DESCRIBED BELOW MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY BY COUNTRY, STATE OR PROVINCE. THIS LIMITED WARRANTY IS GOVERNED BY AND CONSTRUED UNDER THE LAWS OF THE COUNTRY IN WHICH THE PRODUCT PURCHASE TOOK PLACE.
Eye-Fi, Inc. (“Eye-Fi”) warrants to the original purchaser that this hardware product will be free from defects in materials and workmanship for a period of twelve (12) months from the date of original retail purchase.
What We Will Do
If a defect exists, Eye-Fi will, at its option, replace the product with a product that is new or replace the product with a replacement product that has been manufactured from new or refurbished, serviceable used parts and which is at least functionally equivalent to the original product. A replacement product is covered by this Limited Warranty for the remaining period of the Limited Warranty of the original product or sixty (60) days from the date of replacement, whichever is longer.
What Is Not Covered
This Limited Warranty applies only to hardware products manufactured by or for Eye-Fi that can be identified by the “Eye-Fi” trademark, trade name, or logo affixed to them. The Limited Warranty does not apply to any non-Eye-Fi hardware products or any software, even if packaged or sold with Eye-Fi hardware. This Limited Warranty only applies to products purchased from Eye-Fi or an Eye-Fi authorized reseller. For a list of authorized resellers, please go here.
Recovery and reinstallation of system and application software and user data are not covered under this Limited Warranty. This Limited Warranty does not apply: (a) to damage caused by accident, abuse, misuse, misapplication, or non-Eye-Fi products; (b) to a product or a part that has been modified without the written permission of Eye-Fi; or (c) damage caused by Acts of God or other causes beyond the control of Eye-Fi.
Limitation of Warranty/Duration of Implied Warranty
THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. EYE-FI SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF EYE-FI CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.
No Eye-Fi reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty.
Limitation of Liability
EYE-FI IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF PICTURES, VIDEOS, PROGRAMS, DATA OR ANY CONSEQUENCES RESULTING THEREFROM, LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PICTURES, VIDEOS, PROGRAMS OR DATA STORED IN OR USED WITH EYE-FI PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF PICTURES, VIDEOS, PROGRAMS OR DATA STORED ON THE PRODUCT. EYE-FI SPECIFICALLY DOES NOT REPRESENT THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR REPLACE A PRODUCT WITHOUT RISK TO OR LOSS OF PICTURES, VIDEO, PROGRAMS OR DATA.
Your Rights Under State Law
Some states do not allow the exclusion or limitation of incidental or consequential damages or exclusions or limitations on the duration of implied warranties or conditions, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary by state.
How to Obtain Warranty Service/What You Must Do
For the Eye-Fi Customer Care department contact phone number, hours of operations and email, please visit http://support.eye.fi. When contacting Customer Care, you must provide “proof of purchase” information to the Customer Care agent to obtain warranty service. You are responsible for all shipping charges associated with shipping the product to Eye-Fi or Eye-Fi’s authorized representative. Eye-Fi is responsible for all shipping charges associated with shipping a replacement product to you.
EU Disposal Information
Disposal & Recycling – Applicable in the European Union and other countries with separate collection systems.
To prevent possible harm to the environment or human health from uncontrolled waste disposal, please separate the Eye-Fi card and USB Card Reader from other types of wastes and recycle it responsibly to promote the sustainable reuse of material resources.
Household users should contact either the retailer where they purchased this product, or their local government office, for details of where and how they can take this item for environmentally safe recycling. Business users should contact their supplier and check the terms and conditions of the purchase contract.
This product should not be mixed with other commercial waste for disposal.
Recycling Eye-Fi Card and USB Card Reader
Do not dispose of either the Eye-Fi Card or USB Card Reader with your household waste. In some countries or regions, collection systems are set up to handle electrical and electronic waste items. Contact your regional authorities for more details. If collection systems are not available, please return unwanted accessories to any Eye-Fi Approved Service Center in your region.

Changes or modifications to this product not authorized by Eye-Fi could void the EMC compliance and negate your authority to operate the product. This product has demonstrated EMC compliance under conditions that included the use of compliant peripheral devices and shielded cables between system components. It is important that you use compliant peripheral devices and shielded cables between system components to reduce the possibility of causing interference to radios, televisions, and other electronic devices.
